Global Data Solutions Inc. (GDS) Employee portal is owned and operated by Global Data Solutions, Inc. (GDS). Your access and use of GDS's Employee portal is subject to the following Terms and Conditions and all applicable laws. GDS reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms and Conditions at any time and you agree to be bound by such modifications, alterations or updates. You should periodically revisit this page to review the current Terms and Conditions.

Terms

By accessing the GDS employee Portal, you are agreeing to be bound by these Terms and Conditions in whole, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Portal. The materials contained in the Portal are protected by applicable copyright and trade mark law.

User License

Permission is granted to read or download the materials (information, documents or software) from the Portal for staff currently employed by GDS.

Acceptance

By Accepting this Terms and Conditions of Use, you acknowledge that you will not copy, share or distribute the information provided on this Portal to any non-GDS employee. GDS may revise these Terms and Conditions of Use for the Employee Portal at any time without notice. By using the Portal you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

Confidentiality

All material on the GDS Employee portal shall be considered confidential to GDS and, in the case of material provided by third parties (e.g., benefit providers), to our business partners and/or vendors. This material should only be used for its intended purpose and shall not be disclosed outside of GDS, except for third party material submitted to the applicable third party in accordance with its intended use, without the prior written authorization of GDS.

Data Security

GDS restricts access to your personal information to those employees who need to know this information to provide services that you request. Although GDS takes strict precautions to prevent unauthorized access to your personal information, we cannot guarantee that these precautions will prevent third-parties from illegally accessing this information.

Trademarks

The trademarks, logos, and service marks displayed on GDS's Employee portal are the property of GDS. Users are prohibited from using any marks without the written permission of GDS.

Disclaimer/Limitation of Liability

This site is provided ‘as-is’ and your use and browsing of GDS's Employee portal is done at your risk. If you are dissatisfied with any of the materials contained in GDS's Employee portal, or with any of these Terms and Conditions, your sole and exclusive remedy is to discontinue accessing and using GDS's Employee portal.

TO THE FULLEST EXTENT ALLOWED BY LAW, NEITHER GDS NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING GDS'S EMPLOYEE PORTAL OR CONTENT IS LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO, OR USE OF, GDS'S EMPLOYEE PORTAL. GDS'S EMPLOYEE PORTAL AND EVERYTHING ON GDS'S EMPLOYEE PORTAL IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Termination

This Agreement will terminate immediately without notice from GDS if in GDS's sole discretion you fail to comply with any term or provision of this Agreement. Upon termination, you must destroy all materials obtained from GDS's Employee portal and all copies thereof, whether made under the terms of this Agreement or otherwise. In the event of termination, the disclaimers and limitations of liabilities set forth in this Agreement shall survive.
